Dedicated Access Terms and Conditions

These Terms and Conditions of Service apply only to dedicated Internet access products, services and subscribers - please see the main GCI Internet Policies web page for a complete listing of all GCI Internet policies.

  1. DESCRIPTION OF SERVICE
    GCI Internet's dedicated access products include Mission Control and Tsunami. These services are delivered over a private line circuit to a GCI-provided router at the customer's premise and includes 24 x 7 end-to-end management.
  2. GCI OBLIGATIONS
    GCI's CNCC will continually monitor the customer's service up to and including the service demarcation point. In the event of a problem or failure, GCI will notify the customer following the notification process jointly established between GCI and the customer. The CNCC staff will take steps to determine and correct the problem and, if necessary, will escalate the problem to GCI's engineering staff. GCI will provide the customer with on-line web access to management reports and graphs that will assist the customer to monitor the service level agreement and service capacity.
  3. SERVICE DEMARCATION
    As a standard practice, GCI provides a customer premise router to allow GCI to monitor and manage the service delivery all the way to the customer premise. The service demarcation point is the Ethernet port on the GCI provided customer premise router. GCI assumes responsibility for the service up to that point, including coordinating issues with the LEC involving the private line. The title to the GCI provided demarcation router and equipment shall reside with GCI at all times and must be immediately returned upon ermination of service. In the event that the customer chooses not to have GCI install the customer premise router, the service demarcation will be the customer's port on the POP router.
  4. IP ADDRESS BLOCKS
    Customers are normally expected to use private addressing for their internal network needs. GCI will provide sufficient IP Addresses to meet the customer's needs that can be justified according to ARIN (American Registry for Internet Numbers) usage policies. IP network addresses assigned from a GCI net-block are non-portable and must be returned to GCI in the event that the customer discontinues service.
  5. BILLING
    Billing for GCI Internet service will commence when a GCI technician has installed and tested the GCI provided equipment/port(s) regardless of the customer's readiness to accept such service. If the customer chooses to delay the completion of the Internet service after the LEC circuit is installed, GCI will bill the customer for the LEC circuit. The installation charges are invoiced upon acceptance of this Agreement by GCI. LEC Installation and local line charges noted on the service order are controlled by a tariff that is subject to change. Actual LEC charges will be used for invoicing. Installation charges do not cover any time or materials that may be required to extend the circuit from the LEC termination point to the physical location where any GCI demarcation equipment/ports will be installed.
  6. PAYMENT OBLIGATIONS
    Charges shall be invoiced monthly in advance and shall be payable within thirty (30) days. Accounts will be considered delinquent after the thirty-first (31) day and will be handled in accordance with GCI's corporate collection policies. Late fees are assessed for the delinquent portion due with an amount over $10.00 at the rate of either 1.5% or $2.00 (whichever is greater). GCI will attempt to contact the customer by phone and by notices regarding the delinquent bill status. Bills not paid within sixty (60) days of the delinquent date (90 days from the billing date) shall be cause for termination of services. GCI may discontinue service without liability for non-payment of any sum delinquent more than sixty (60) days. In addition, termination of services under these circumstances does not relieve the customer of the obligation to pay for said past due amounts or other obligations that may exist under any applicable term agreements. Applicable State and Federal taxes will be passed through as the responsibility of the customer. If the Service becomes tariffed, the tariff will supersede any conflicting provisions of the Agreement. At GCI's request, the Customer shall post a bond or provide a security deposit to assure payment.
  7. PRICE CHANGES
    1. For customers on month-to-month agreements:
      Revisions of the applicable rates and charges which result in any price increase or any material modification of the service will become effective sixty (60) days after GCI provides written notice to the Customer of its intent to revise such rates or service. In the event that the Customer receives such notice, the Customer may elect, upon written notice to GCI, to discontinue service - subject to the cancellation clause noted in section 7 below. If a price change results in a net decrease to the customer's monthly charge, GCI will adjust the customer's bill to reflect the reduction, but is not obligated to notify customer.
    2. For customers on term agreements:
      GCI will not automatically change the pricing for existing term agreements. If GCI reduces the pricing of its Internet service, customers make take advantage of reduced pricing by entering into a new term agreement that extends the term beyond the expiration date of their current term agreement.
  8. AUTOMATIC RENEWAL/CANCELLATION OF SERVICE
    The term of service is set forth on the Internet Service Agreement and shall automatically renew for successive thirty (30) day terms unless either party provides the other thirty (30) days prior written notice that it does not wish to renew. Any cancellation/termination of service - regardless of term or month-to-month service - must be provided by email to support@gci.net with 30 days advanced notice. The Customer is responsible for payment of services through the later of the cancellation date or the end of the 30-day time period from date of notification.

    Upon termination of service, customers are required to return all GCI -owned customer premise equipment within 30 days of the last day of their service. If equipment is not received by GCI within 30 days, customer will be subject to a a non-returned equipment fee equal to the greater of $2,000 or the GCI list price of the equipment.
  9. EARLY TERMINATION
    If Customer chooses to terminate service prior to the expiration of an existing term agreement, a cancellation charge equal to the lesser of six times the customer's monthly rate or the remainder of the contract will be applied in addition to any discounted or waived installation fees.
  10. SERVICE CHANGES
    Early termination penalties will not apply if the customer chooses to switch to another GCI Internet service during the term of service, providing the term of service is not less than the original term of service. The customer will be responsible for a one-time service charge equal to the difference of the monthly fee between the services in addition to all fees associated with installing the new service. In all cases the customer must provide 30 days advanced notice as described in #7, above.
  11. SERVICE MOVES
    If the customer moves the location to where the Internet service is delivered, the customer will be responsible for any LEC charges to move the service. If the same Internet POP (all of Anchorage is considered the same POP) serves the customer's new location, there will be a $100 one-time charge. If a different Internet POP serves the customer's new location, the customer will be responsible for the full Internet installation fee. In all cases the customer must provide 30 days advanced notice as described in #7, above.
  12. USAGE CHARGES
    Tsunami Internet service is a product that is subject to charges for usage. There are several service plans that offer different speeds and may or may not included some usage in the monthly base fee. The customer is responsible for all additional usage above the monthly usage included in the plan. The Internet service agreement should list the included usage in the plan. If no included usage is listed, the customer should assume that no usage is included. GCI will make a web URL available to the customer to view the month-to-date Internet usage.

    Mission Control Internet service does not include additional usage charges.
